BOOKING TERMS & CONDITIONS TravelPaths LTD | Oldcastle, Co. Meath, Ireland IAA Travel Agent Licence T0601 — Bonded These Terms & Conditions apply to all bookings made through www.sunholidays.ie 1. Introduction & Formation of Contract These Booking Terms and Conditions govern all holiday bookings made with sunholidays.ie, a trading name of TravelPaths LTD, a company registered in Ireland ("the Company", "we", "us", "our"). Our registered address is Oldcastle, Co. Meath, Ireland. We hold a Travel Agent Licence (No. T0601) issued by the Irish Aviation Authority (IAA) and are fully bonded in accordance with the Package Holidays and Travel Trade Act 1995 (as amended by S.I. No. 80 and 105 of 2019). A binding contract between you and the Company is formed when we issue a written Booking Confirmation to you by email, following receipt of your deposit or full payment. The person who completes the booking accepts these Terms on behalf of all members of their party and takes responsibility for all payments due from the group. All bookings are subject to availability and are only available to persons aged 18 or over. By submitting a booking on our website, you confirm that you are at least 18 years of age and are legally entitled to make this booking. 2. Your Booking 2.1 Booking Process You can book a holiday through our website at www.sunholidays.ie. When you submit a booking, you will receive an automated acknowledgement. This acknowledgement does not constitute a confirmed booking. Your booking is only confirmed when you receive a Booking Confirmation invoice from us by email. Please check your Booking Confirmation carefully. If any detail is incorrect, you must notify us within 24 hours of receipt at This email address is being protected from spambots. The Company cannot accept responsibility for errors not reported within this timeframe. 2.2 Lead Passenger Responsibility The person making the booking (the "Lead Passenger") is responsible for ensuring that all members of the travel party are aware of and agree to these Terms and Conditions. The Lead Passenger accepts financial responsibility for all amounts due from the entire party. 3. Pricing & Price Changes All prices quoted on our website are per person unless otherwise stated and are based on the number of passengers specified. Prices include all advertised components (flights, accommodation, and any specified transfers or board basis). 3.1 Price Guarantee After Booking Once your Booking Confirmation has been issued, the price of your holiday is guaranteed and will not be increased EXCEPT in the following circumstances as permitted under the EU Package Travel Regulations (S.I. 80/2019): • Increases in the cost of passenger transport resulting from changes in fuel costs or other energy sources; • Increases in taxes or fees imposed by third parties (including airport taxes, landing charges, or port embarkation/disembarkation fees); • Fluctuations in exchange rates where the package price is linked to a foreign currency. Any such increase will only apply if it exceeds 2% of the total package price. If a price increase exceeds 8%, you have the right to cancel without penalty. We will notify you of any price increase no less than 20 clear days before your departure date. 3.2 Pricing Errors We reserve the right to correct any obvious pricing errors on our website before a Booking Confirmation is issued. If a clear pricing error is identified after Booking Confirmation, we will contact you promptly and offer you the option to proceed at the correct price, accept a substitute holiday, or receive a full refund. Taxes and departure charges can fluctuate due to exchange rate movements and will be recalculated at the time final balance payments are collected, in accordance with your Booking Confirmation. 4. Payment — Deposits, Instalments & Balances ⚠ This section governs our automatic payment collection. Please read it carefully before completing your booking. 4.1 Payment Options When booking at www.sunholidays.ie, you may choose from the following payment options, subject to availability and to the departure date of your holiday: Option A — Pay in Full You may pay the total cost of your holiday at the time of booking. This option is available for all bookings regardless of departure date. Once payment is made in full, no further card charges will be made by the Company in respect of the booking, except in the limited circumstances set out in Clause 3.1. Option B — Low Deposit + Monthly Instalments Available when booking at least 8 weeks before your scheduled departure date. You secure your holiday with a low deposit of €20 per person at the time of booking. Thereafter, your remaining balance is divided into equal monthly instalments, with the final payment due 14 days before your departure date. Each instalment payment (excluding the initial deposit) incurs an administration fee as shown during the booking process. Administration fees paid in connection with the monthly instalment plan are non-refundable, even if you subsequently choose to pay your outstanding balance in full before the scheduled balance due date. Option C — Standard Deposit + Balance Available when booking at least 4 weeks before your scheduled departure date. You pay a standard deposit at the time of booking (the amount varies by holiday and is displayed during the booking process), with the remaining balance due 14 days before departure. 4.2 Automatic Card Charging — Important BY COMPLETING YOUR BOOKING AND ACCEPTING THESE TERMS AND CONDITIONS, YOU EXPRESSLY AUTHORISE TRAVELPATHS LTD (TRADING AS SUNHOLIDAYS.IE) TO AUTOMATICALLY CHARGE THE CREDIT OR DEBIT CARD USED TO PAY YOUR INITIAL DEPOSIT FOR ALL SUBSEQUENT SCHEDULED PAYMENTS, INCLUDING: • Each monthly instalment on the date specified in your Booking Confirmation or payment schedule; • The final balance payment on the balance due date specified in your Booking Confirmation; • Any revised instalment amounts where a payment date falls within 14 days of the balance due date (in which case the instalment is absorbed into the final balance payment); • Any supplementary amounts arising from permitted price adjustments under Clause 3.1. You will be informed of all scheduled payment dates and amounts during the booking process and these will be confirmed in your Booking Confirmation. You can view your payment schedule at any time by logging into the 'Manage My Booking' section of our website. This authorisation constitutes a Continuous Payment Authority (CPA) and remains in force until all amounts owing under your booking have been collected in full, or until your booking is cancelled in accordance with these Terms. 4.3 Changing Your Payment Card If you need to change the card from which your scheduled payments are collected, you must notify us at This email address is being protected from spambots. We cannot guarantee that a card change request received less than five working days before a payment date will be processed in time to prevent a charge to the original card. 4.4 Failed Payments If we are unable to collect a scheduled instalment or the final balance from your card on the due date, we will notify you promptly and, where possible, attempt to collect the payment again within a reasonable period thereafter. You remain responsible at all times for ensuring that all scheduled payments are made by the due dates. If full payment is not received by the balance due date, the Company reserves the right, after giving you reasonable notice, to treat your booking as cancelled by you and to apply the cancellation charges set out in Clause 6. You will remain liable for all applicable cancellation fees even if the booking is cancelled due to non-payment. You need JavaScript enabled to view it. within 14 days and we will investigate promptly. 4.5 Payment Methods Accepted We accept the following payment methods for online bookings: • Visa credit and debit cards; • Mastercard credit and debit cards. We do not charge a fee for card payments. Please note that your card issuer or bank may apply foreign transaction fees, over which we have no control. 5. Amendments to Your Booking 5.1 Amendments by You If you wish to make any change to your confirmed booking (such as a name correction, date change, room upgrade, or additional extras), you must notify us in writing at This email address is being protected from spambots. You need JavaScript enabled to view it., quoting your booking reference. We will endeavour to accommodate your request, subject to availability. All amendment requests are subject to any charges imposed by the relevant suppliers (airlines, hotels, transfer providers), plus an administration fee as notified to you at the time of the amendment request. Amendment fees are payable at the time the amendment is applied to your booking and are non-refundable. Please note that some changes, particularly to flights, may be treated by the airline as a cancellation and rebook, which could result in the loss of your original fare and applicable cancellation charges. We will advise you of this before processing any such change. 5.2 Name Changes Most airlines treat name changes as a cancellation and rebooking at the current fare. We will advise you of the cost before proceeding. Minor corrections to misspellings may attract a lower fee; please contact us as early as possible. All names on your booking must match the relevant travel document (passport or national ID) exactly. 6. Cancellations by You 6.1 How to Cancel You, or any member of your party, may cancel your confirmed booking at any time before departure. Cancellations take effect from the date we receive your written cancellation. 6.2 Flight Element — 100% Non-Refundable IMPORTANT: The flight portion of every package holiday booked through sunholidays.ie is 100% non-refundable from the moment your booking is confirmed, regardless of how far in advance of departure you cancel. This is because airlines issue tickets and take payment from us at the point of booking, and these costs are non-recoverable from the airline. The flight element includes the airfare itself together with any associated charges such as airline taxes, fuel surcharges, baggage fees, seat selection, in-flight extras, and travel insurance purchased at the time of booking. If you cancel your booking, we will refund any recoverable supplier costs in respect of the non-flight elements only, less the cancellation charges set out in Clause 6.3 below. The flight element will not be refunded under any circumstances except where you have an applicable claim under your travel insurance policy or under EU Regulation 261/2004 directly against the airline. 6.3 Cancellation Charges (Non-Flight Elements) The cancellation charge bands set out below apply to the NON-FLIGHT elements of your booking only (accommodation, transfers, board upgrades, excursions, and any other land arrangements). These charges are calculated based on the number of days before your scheduled departure date on which we receive your written cancellation: • More than 70 days before departure: Loss of deposit only (against non-flight elements); • 43–70 days before departure: 30% of non-flight holiday cost; • 29–42 days before departure: 50% of non-flight holiday cost; • 15–28 days before departure: 70% of non-flight holiday cost; • 8–14 days before departure: 90% of non-flight holiday cost; • 7 days or less before departure, or no-show: 100% of non-flight holiday cost. These cancellation charges apply IN ADDITION TO the 100% non-refundable flight element described in Clause 6.2 above. The total amount payable on cancellation is therefore the full flight cost plus the applicable percentage of the non-flight elements. Where you have chosen a low deposit payment option and the deposit paid at the time of cancellation does not cover the applicable cancellation charges (including the non-refundable flight element), you remain liable to pay the difference between the amounts already paid by you and the total cancellation charge applied. By accepting these Terms, you authorise us to charge this balance to the card on file. A cancellation processing fee of €50 per booking applies in addition to the cancellation charges set out above. 6.4 Cancellation for Unavoidable & Extraordinary Circumstances In accordance with the EU Package Travel Regulations (S.I. 80/2019), you have the right to cancel your booking without paying cancellation charges (other than unavoidable and non-refundable costs already incurred — which will, in most cases, include the flight element) if unavoidable and extraordinary circumstances occurring at or in the immediate vicinity of your destination significantly affect the performance of the package or the carriage of passengers to the destination. In such cases, you will receive a refund of all recoverable monies within 14 days. 7. Changes & Cancellations by the Company 7.1 Significant Changes We reserve the right to make changes to your holiday before or after booking. Most changes are minor (such as a flight time change of less than 12 hours or a hotel change of equivalent or higher standard). If we need to make a significant change to a confirmed booking, we will notify you as soon as possible and offer you: • A suitable alternative holiday of equivalent or superior quality, if available; • A lower-grade holiday with a refund of the price difference; • A full refund of all monies paid. Significant changes include: a change in departure airport (to a different airport in a different metropolitan area), a reduction in the standard of your accommodation by more than one star, a change in your destination, a flight time change of more than 12 hours, or an increase in price of more than 8%. 7.2 Cancellation by the Company We reserve the right to cancel your holiday in exceptional circumstances, including where we have insufficient numbers to make a particular tour or flight viable, or where force majeure events make it impossible to operate the holiday. If we cancel your holiday, we will offer you the same alternatives as set out in Clause 7.1 above. 7.3 Force Majeure We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, war, terrorism, civil disturbance, industrial action, natural disasters, epidemic or pandemic, government action, airport closures, or other unavoidable and extraordinary circumstances. In such cases, your rights are as set out in Clause 6.4 above. 8. Financial Protection & IAA Bonding TravelPaths LTD (trading as sunholidays.ie) holds a Travel Agent Licence issued by the Irish Aviation Authority (IAA) and is fully bonded in accordance with the Package Holidays and Travel Trade Act 1995, as amended. Our IAA Travel Agent Licence Number is T0601. As a licensed and bonded travel agent, we are required to maintain a bond for the protection of our customers. This means that if we are unable to provide your holiday due to our insolvency, you are financially protected. The IAA administers the bond on behalf of our customers, with recourse also available to the Travellers' Protection Fund where applicable. In the event of insolvency: • If you have not yet departed, you will receive a refund of monies paid to us, recoverable from the bond and (where applicable) the Travellers' Protection Fund; • If you are abroad at the time of insolvency, arrangements will be made to repatriate you to Ireland. Further information on IAA bonding and consumer protection is available at www.iaa.ie. This financial protection applies to package holidays sold by us and does not extend to standalone flights, standalone accommodation, or other travel services sold individually. 9. Our Responsibilities We accept responsibility for the proper performance of all elements of the package holiday as described in your Booking Confirmation, except where failure is attributable to: (a) your own acts or omissions; (b) the acts or omissions of a third party unconnected with the provision of the services; or (c) unavoidable and extraordinary circumstances. Our liability to you is limited in accordance with and/or in an identical manner to: • The relevant provisions of the Package Holidays and Travel Trade Act 1995 (as amended); • The Montreal Convention (carriage by air); • The Athens Convention (carriage by sea); • The Berne Convention (carriage by rail). We do not exclude or limit liability for death or personal injury resulting from our negligence or that of our employees acting in the course of their employment. 10. Your Responsibilities As a customer, you are responsible for the following: 10.1 Travel Documents You are responsible for ensuring that you and all members of your party hold valid passports (with at least six months' validity beyond your return date), all necessary visas, and any required health documentation for your destination. Non-Irish passport holders should consult the Embassy of their destination country regarding entry requirements. The Company accepts no responsibility for any costs, losses, or disruption arising from failure to hold valid documentation. 10.2 Health & Vaccinations You are responsible for ensuring that you have received any required or recommended vaccinations for your destination. Please consult your GP or visit www.tmb.ie for up-to-date travel health information. If you or any member of your party has a pre-existing medical condition, please contact your travel insurer before booking to ensure you have adequate cover. 10.3 Travel Insurance We strongly recommend that all customers take out comprehensive travel insurance at the time of booking. At minimum, your policy should cover: medical expenses and emergency repatriation; cancellation and curtailment; personal liability; and loss or theft of baggage. The Company is not responsible for any losses that could have been covered by adequate travel insurance. This is particularly important given that the flight element of your booking is 100% non-refundable from the point of booking (see Clause 6.2). 10.4 Behaviour You and all members of your party are expected to conduct yourselves in a responsible manner at all times throughout your holiday. If your behaviour, or that of any member of your party, is deemed by the Company, the airline, accommodation provider, or their representatives to be likely to cause danger, distress, or significant annoyance to others, we reserve the right to terminate your holiday arrangements without refund. You will be responsible for all costs of your own return travel in such circumstances. 11. Special Requests If you have a special request (such as a dietary requirement, room preference, or accessibility need), please advise us at the time of booking. We will pass all reasonable requests on to the relevant suppliers, but we cannot guarantee that any request will be met. The inclusion of a special request in your Booking Confirmation does not constitute a guarantee that it will be fulfilled. Special requests do not form part of the contract between you and us. If you have a medical condition or disability that may affect your holiday arrangements, please tell us before you book so we can advise on the suitability of the holiday and discuss any special requirements. 12. Complaints If you experience a problem during your holiday, you must report it immediately to the accommodation provider, airline, or our local representative, as applicable, to give them the opportunity to resolve the issue at the time. Failure to report a problem while it could reasonably be resolved may affect your right to claim compensation. You need JavaScript enabled to view it. within 28 days of your return date, quoting your booking reference. Complaints received more than 28 days after your return date may not be considered. We will acknowledge your complaint within 7 working days and provide a substantive response within 28 days. In the event of a dispute that cannot be resolved directly with us, you may refer the matter to: • The Small Claims Court (for claims up to €2,000 — where the Company is based in Ireland); • The European Small Claims Procedure (for EU/EEA travel organisers — claims up to €5,000); • Arbitration through the Travel Scheme of the Chartered Institute of Arbitrators (CIArb) — Ireland Branch; • The European Consumer Centre (ECC) Ireland for cross-border disputes. 13. Flights All departure and arrival times shown in your Booking Confirmation are in the local time zone of the respective airport. Flight times are approximate and subject to air traffic control restrictions, weather conditions, or other operational requirements. The Company is not liable for any costs, losses, or disruption resulting from changes to flight schedules by the airline. As set out in Clause 6.2, the flight element of your booking is 100% non-refundable from the point of booking. Any compensation for flight delay, cancellation, or denied boarding under EU Regulation 261/2004 must be claimed directly from the operating airline. The minimum check-in time for most flights is 2 hours before departure; however, please check your specific airline's requirements. Failure to check in before the gate closes may result in you being denied boarding, and the Company accepts no responsibility for costs incurred as a result. Missed flights are 100% non-refundable. If your flight is delayed at the departure airport for more than the thresholds set under EU Regulation 261/2004, the airline (not the Company) is responsible for providing refreshments, meals, and communication facilities. Please direct any EU 261 compensation claims to the relevant airline directly. All baggage allowances are as specified in your Booking Confirmation. Additional baggage charges imposed at the airport are your responsibility. Please visit www.daa.ie for the latest information on restricted items in cabin baggage. 14. Accommodation Accommodation star ratings and descriptions are provided by the relevant hotel or accommodation provider and are based on local classification standards, which vary by country. Star ratings in other countries are not directly comparable to Irish standards. We take reasonable care to provide accurate accommodation descriptions but cannot guarantee that descriptions remain accurate at all times, as properties change ownership and undergo renovation. Standard hotel check-in time is generally 14:00 and check-out is generally 12:00 (noon), though this varies by property. Early check-in or late check-out is subject to availability and may incur a charge payable directly to the hotel. Room allocation is at the hotel's discretion; we can pass on room preference requests but cannot guarantee specific rooms or floors. Some hotels may charge a refundable damage deposit or a resort fee directly to guests on arrival. These charges are not included in our holiday price and are payable directly to the hotel. 15. Insurance The Company does not include travel insurance in the price of your package holiday. We strongly advise you to arrange comprehensive travel insurance at the time of booking. This is particularly important as many elements of your package — most notably the entire flight element — are non-refundable from the point of booking. If you choose to purchase travel insurance through our platform, please note that this insurance is provided by a third-party insurer and does not form part of your package for the purposes of the EU Package Travel Regulations. For queries about your insurance policy, please contact the insurer directly. 16. Data Protection & Privacy TravelPaths LTD takes your privacy seriously. We collect and process personal data in accordance with our Privacy Policy, which is available at www.sunholidays.ie/privacy-policy, and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018. To process your booking, we collect personal information including: passenger names, contact details, passport/travel document information, and payment card details. This information is processed solely for the purpose of managing your booking and is shared only with suppliers (airlines, hotels, transfer companies) as necessary to fulfil your holiday arrangements. Payment card data is processed in accordance with the Payment Card Industry Data Security Standard (PCI DSS). We do not store your full card number. By accepting these Terms, you consent to us storing and using your payment card details for the purposes of collecting scheduled instalment payments as set out in Clause 4.2 above. Website Terms of Use The content of www.sunholidays.ie, including all text, pricing, images, and destination information, is the property of TravelPaths LTD or its licensors. You may use the website for the personal purpose of searching for and purchasing a holiday. You may not copy, reproduce, or commercially exploit any content from our website without our prior written consent. While we take reasonable care to ensure that the information on our website is accurate, prices and availability change frequently and are not guaranteed until a Booking Confirmation is issued. Our website is intended for use by Irish residents booking holidays from Irish airports unless otherwise stated. 18. Governing Law & Jurisdiction These Terms and Conditions are governed by and construed in accordance with the laws of Ireland. Any dispute arising from or in connection with your booking shall be subject to the exclusive jurisdiction of the Irish courts, subject to your rights under applicable EU consumer protection law, including your right to refer disputes to the relevant alternative dispute resolution body listed in Clause 12. 19. General If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable to any extent, such provision shall be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law. These Terms and Conditions, together with your Booking Confirmation and any specific written amendments agreed by the Company, constitute the entire agreement between you and the Company in respect of your booking. Any verbal representations not confirmed in writing by the Company do not form part of the contract. We reserve the right to update these Terms and Conditions at any time.
